雙美解除代理 重掌行銷通路

雙美解除亮靚公司台灣區代理合約(自立電子報2012/02/29)  雙美生技(4728)29日舉行重大訊息記者會，宣布與亮靚公司解除台灣地區膠原蛋白植入劑產品總代理合約。  雙美去年7月12日與亮靚醫美生技公司簽訂膠原蛋白植入劑台灣區總代理合約，合約期限至2016年12月31日止，合約期滿時，若雙方均無表示，視同舊約自動延續2年。  雙美董事長王進富表示，與亮靚生技公司簽訂代理合約後，須將原有客戶移轉給亮靚公司，使得產品銷售由直接銷售模式，改為透過代理商間接銷售給醫美診所，使得醫美診所向亮靚生技公司進貨的成本提高。為保障原有客戶的獲利空間、避免價格混亂，進而影響消費者使用產品的意願，雙美生技已與亮靚生技公司達成協議，自即日起解除代理合約，改由雙美行銷團隊自行負責行銷，此舉將有助於提升產品毛利。

武田賠健亞5000萬

健亞智財訴訟 將獲大筆賠償金  【2012/03/01 經濟日報】 健亞生技昨（29）日宣布，日本武田藥廠控告健亞侵權求償官司案纏訟七年七個月，最終三審定讞，健亞勝訴，在今年第二季前將獲得5,000萬元訴訟賠償金。   健亞生技總經理陳正表示，這一場「小蝦米對抗大鯨魚」的戲碼終於落幕，創下國內醫藥智財訴訟里程碑。   健亞指出，這場被國內醫藥喻為「小蝦米對大鯨魚」的土洋官司，全程分為兩階段，從民國93年間，武田就以健亞與世育公司合作的單方藥品Vippar臨床試驗，聲請侵害武田的複方專利為由要求法院對健亞進行「假處分」。當時，台中地院裁定准許武田假處分之請求，並禁止健亞製造、販賣或推廣促銷該項產品；之後健亞與武田展開官司訴訟，開庭24次，二審於98年3月判健亞未侵權。   陳正表示，國外大廠用各項專利訴訟，拖慢競爭對手的研發、上市進度是行之有年的方式。

臍帶幹細胞抗癌??

臍帶治癌事件 創威負責人被拘提  【2012/03/01 聯合報】             彰化縣罹患肺癌的男子，昨天終於願意接受檢察官葉建成訊問，說出去年到台南市創威生技公司接受左手臂植入臍帶幹細胞抗癌，及感到不適求助彰基醫院的過程；檢警隨即趕往台南拘提公司負責人鄭創威、女業務員蔡淑萍，帶回彰化偵訊。   葉建成掌握具體事證後，向法官聲請搜索票，指揮北斗警方會同台南市衛生局人員，前往位在台南市仁德區的創威生技公司等多處搜索，查獲針筒等醫療器材和臍帶等證物，但未發現接受手術患者資料。   據了解，鄭威創是掛名的負責人，為患者操刀植入臍帶幹細胞的「醫師」另有其人，檢警仍積極偵查拘提。   住在彰化縣北斗鎮的肺癌患者，前年聽到朋友提到植入臍帶幹細胞手術，感覺很不錯，索取資料與創威公司的蔡淑萍聯繫，並在去年1月前往台南接受植入手術。到去年七月，患者感覺胸悶，呼吸困難，認為與植入手術有關，到彰基醫院求診，醫師感覺不可思議，開刀幫他取出。   日前彰基開記者會揭露此事，事後檢警採取行動時，創威公司人員已警覺，清理過「執業」場所，隱藏許多病例和事證，檢警設法突破案情。   彰化縣衛生局長葉彥伯說，為避免有人再上當，花錢又受罪，衛生局即日起建立通報機制，醫療院所發現病人接受違法醫療，立刻通報以便衛政單位迅速追查非法醫療行為，衛生局將積極宣導正確醫療資訊，同時開放檢舉和諮詢專線（04）7115141轉301～305。   台南市衛生局官員也說，如果未來發現有醫療院所違法出售臍帶，將依法處分。負責植入手術的醫師也會移送懲戒，並可依違法醫療法，處分6萬到30萬元。
